The problem of course is, and let's play by the hypothesis that hutch
didn't get permission and is plainly lying (which I doubt), that MS
might not be caring right now. But what happens when somebody writes
a killer app using a masm version from the MASM32 project, and MS
decides that it's time to stop not caring? Of course the software
developer could just lie and say he got ml.exe and friends from the
98ddk, unless he had "created using MASM32" somewhere in his docs.

Oh well.

I think it would offer some peace of mind to a bunch of developers
if hutch made it clear in the MASM32 documentation that he has legal
rights of redistribution, even if he cannot cite NDA emails. And it
might eventually shut up some people.
