I doubt that it is ever 'illegal' to sell what is being offered here.
It _may_ be subject to contract law which may result in a _civil_ case
(ie breaking a contract is not 'illegal', but may make one liable to
damages).

The seller is not offering a 'licence to use'. If the _buyer_ attempts
to use the product then _they_ may be in breach of copyright (ie
without a licence).
