My understanding is this is the Borland Legal position

The way I heard it explained is that SOX has regulations concerning
when revenue is reported. Take this simple scenario:

I buy SoftwareX version 2.0 in November, 2005. The company reports the
revenue for that sale during Q4 2005. Now, the company releases an
update in February, 2006, that provides additional functionality that
wasn't in the original product. But I didn't pay extra for that update.

Therefore, part of the money that I paid in November contributed to
functionality that I received in February. So they are saying that
portion of the sale should be reported in Q1 2006, not Q4 2005.

I have no idea whether this is valid or not. It's just how I heard it
explained.
