Yes on both counts. But what is worse is that the law is not simply
badly written (though perhaps that too) but deliberately vague
precisely to give power to goverment to decide when and if a company
has violated the law.
Yes, ok, but [bad words] it should be possible for any citizen, any
company, any entity to ask the authorities:
"We do A + B and not C but then D, can we do this?Is this legal?"
Then you should be on safe ground.
If they refuse to give a distinct answer, then you should definitely be
on safe ground as you would then be in "good belief" as we say it here
- you have done what you could do with the resources you had.
