So I use my D7 to update to D2007, then sell it to somebody else, who also uses it to get D2007 at an upgrade price.
Since my right to transfer would be unconditional, it looks like this would be perfectly valid under the system you propose.

User has a LICENCE for D7.
User upgrades his licence to D2007 (which should also allow him to run D7)
--- At this point, LICENCE -> D2007 (-> D7), there is no longer a LICENCE -/-> D7
So whether the licence is transferred or not, there is only one LICENCE which could be used in any upgrade to D2008+
